Terms and Conditions of Sale

These Terms and Conditions of Sale ("Terms of Sale") govern the sale of products by Onaboc through the website onaboc.com (the "Site") to consumers. They are established in accordance with the French Consumer Code (Code de la consommation) and apply to all orders placed on the Site.
By placing an order on the Site, you accept these Terms of Sale in full.

2. Scope
These Terms of Sale apply, without restriction, to all sales concluded by Onaboc with consumers ("Customers") wishing to purchase products offered on the Site. They apply exclusively to sales made to consumers residing in [Insert: France / the European Union].
3. Products
Products offered for sale are described and presented as accurately as possible on the Site. However, minor variations in color, texture, or appearance may occur due to photography or screen display and do not constitute a defect. Product availability is indicated at the time of order and may change without notice.
4. Prices
Prices are indicated in [Insert Currency, e.g., EUR], inclusive of applicable VAT, unless otherwise stated. Shipping costs are indicated separately at checkout before order confirmation.
Onaboc reserves the right to modify its prices at any time; however, products will be billed based on the price in effect at the time the order is confirmed.
5. Order Process
- The Customer selects products and adds them to the shopping cart.
- The Customer reviews the order summary, including product details, price, and shipping costs.
- The Customer provides delivery and billing information.
- The Customer confirms the order and proceeds to payment.
- Order confirmation is sent by email, constituting acceptance of the sale, subject to product availability and payment validation.
Onaboc reserves the right to cancel or refuse any order from a Customer with whom there is an existing dispute, or in cases of suspected fraud or payment irregularities.
6. Payment
Payment is due in full at the time of order. We accept the payment methods indicated at checkout. Payments are processed securely through our payment providers; Onaboc does not store full payment card details.
The order will only be considered final once payment has been validated.
7. Delivery
Delivery terms, timeframes, and costs are set out in our Shipping Policy, which forms an integral part of these Terms of Sale.
Onaboc cannot be held liable for delays caused by carriers, customs, or events beyond its reasonable control.
8. Right of Withdrawal
In accordance with Article L221-18 of the French Consumer Code, the Customer has a period of 14 calendar days from receipt of the goods to exercise their right of withdrawal, without having to justify their decision or pay any penalty, except for return shipping costs.

This right of withdrawal does not apply to personalized products, made-to-order items, or products that are unsealed after delivery and cannot be returned for hygiene reasons, in accordance with Article L221-28 of the French Consumer Code.
9. Legal Warranties
All products sold on the Site benefit from the following legal guarantees, which apply regardless of any commercial warranty:
- Legal guarantee of conformity (Articles L217-3 et seq. of the French Consumer Code): the Customer has 2 years from delivery to invoke this guarantee for defects existing at the time of delivery.
- Legal guarantee against hidden defects (Articles 1641 et seq. of the French Civil Code): the Customer may request a refund or price reduction if the product suffers from a hidden defect that renders it unfit for its intended use.

10. Liability
Onaboc's liability cannot be engaged for damages arising from misuse of the products, force majeure, or actions of third parties. In any case, Onaboc's liability, if established, shall be limited to the amount paid by the Customer for the relevant order, except in cases of gross negligence, willful misconduct, or where liability cannot be limited under applicable law.

12. Mediation and Dispute Resolution
In the event of a dispute, the Customer may first contact our customer service at support@onaboc.com to seek an amicable resolution.
If no amicable solution is reached, the Customer may refer the matter to a consumer mediator or to the European Online Dispute Resolution (ODR) platform: https://ec.europa.eu/consumers/odr.
13. Applicable Law and Jurisdiction
These Terms of Sale are governed by French law. Any dispute relating to their interpretation or execution shall fall under the jurisdiction of the competent French courts, subject to mandatory consumer protection provisions applicable to Customers residing in the European Union.
14. Amendments
Onaboc reserves the right to modify these Terms of Sale at any time. The applicable version is the one in effect on the Site at the time the order is placed.
